Campbell Partners Obtains Favorable Final Judgment in Contract Dispute: Wins Nearly$400,000 for Client.
Andy Campbell and Yawanna McDonald recently represented a Madison County doctor in a breach of contract dispute. Campbell Partners’ client was an owner in a physician-owned outpatient surgery center in Madison County. After a laudable career, Campbell Partners’ client made the decision to close her practice. After notifying the surgery center of her decision to close her medical practice, the surgery center offered Campbell Partners’ client half the fair market value of her shares in the surgery center.
Pursuant to the contract between the parties, Campbell Partners’ client’s departure from the surgery center was a valid disassociating event triggering a buyout for the full value of her shares. The surgery center disagreed with this interpretation of the contract; however, after a two-day bench trial the Circuit Court of Madison County sided with Campbell Partners and awarded Campbell Partners’ client the full fair market value of her shares, which amounted to approximately $400,000.
